1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Oemer Kaya, trading as Rockuno (an Einzelunternehmen incorporated under German law, hereinafter "Rockuno," "we," "us," or "our"), governing your access to and use of the Shotexa iOS mobile application (the "App") and all related services.

These Terms apply whether you use Shotexa as a guest, create an account, upload images, generate content, purchase credits, or subscribe to paid features. By downloading the App from the Apple App Store, continuing as a guest, creating an account, or using any feature of the App, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional terms applicable to specific features.

If you do not agree to these Terms, you must not download, install, or use Shotexa.

These Terms apply solely to the Shotexa mobile application. They do not govern any other products or services offered by Rockuno.

2. Description of Service

Shotexa is an AI-powered product photo transformation and background generation mobile application for iOS. The App enables users to:

Core image generation features are available to both guest users and registered users. Certain features — such as saving and syncing generation history across devices, account management, and account deletion — require registration.

The App's AI functionality is powered by our backend API infrastructure (hosted at api.rockuno.com on Vercel) and third-party AI processing providers. Results are generated algorithmically and may vary in quality, style, and accuracy.

Rockuno reserves the right to modify, suspend, or discontinue any feature of the App at any time with reasonable notice. We may also introduce new features, which will be subject to these Terms unless separate terms are provided.

Shotexa is distributed exclusively through the Apple App Store. All App Store-related terms also apply.

3. Eligibility

Shotexa is not directed to children. However, the App is rated 4+ on the Apple App Store and may be used by users of different ages where permitted by applicable law and Apple App Store rules.

If you are under the age at which you can legally consent to digital services in your country, you may use Shotexa only with the involvement and consent of a parent or legal guardian.

In the European Economic Area, where GDPR child consent rules apply, users under the applicable national digital age of consent must have the consent of a parent or legal guardian where required by law.

You must have the legal capacity to enter into a binding contract, or use the App with the consent and supervision of a parent or legal guardian.

You must not be prohibited from using the App under the laws of your country of residence.

If you are using Shotexa on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms.

We do not knowingly collect personal data from children without the required parental consent. If we become aware that personal data has been collected from a child without required consent, we will take appropriate steps to delete it.

By using Shotexa, you represent and warrant that you meet the applicable eligibility requirements. If Rockuno becomes aware that a user does not meet these requirements, we reserve the right to restrict or terminate access.

4. Account Registration and Guest Access

4.1 Guest Access

You may use Shotexa's core image generation features without creating an account by continuing as a guest. Guest access is provided through anonymous authentication (Supabase Anonymous Auth), which assigns you an anonymous session identifier. No email address or password is required for guest usage.

Guest mode may have limitations compared with registered accounts. Certain features require account creation, including saving and syncing your generation history across devices, account management, account deletion, and persistent access to generated results after uninstalling the App.

4.2 Account Registration (Optional)

Account registration is optional. Creating an account may be required for account-based features such as saving and syncing generations across devices, managing account settings, requesting account deletion, and linking purchases or credits to a permanent account.

When creating an account, you agree to:

4.3 Guest Free Credit

Guest users receive 1 free credit, subject to eligibility. Free guest credits are:

Attempting to obtain repeated guest credits through reinstalling the App, resetting anonymous sessions, creating repeated new guest sessions, manipulating device identifiers or IP addresses, using VPNs or proxies to bypass limits, automation, or similar abuse is strictly prohibited. Shotexa may deny or revoke promotional credits if abuse is detected.

4.4 Registered Account Bonus

Users who create and verify a registered account may receive a one-time 3-credit account bonus. This bonus is:

Creating multiple accounts, using disposable email addresses, automated signups, or any other attempt to farm the account bonus is prohibited. We reserve the right to withhold or revoke bonus credits in cases of suspected fraud, abuse, or violation of these Terms.

4.5 Account Conversion

If a guest user subsequently creates a registered account, certain guest session data, credits, purchases, or generated content may be linked to the new account where technically supported. We do not guarantee that all guest session data will be recoverable if the App is deleted, the session is lost, or the device is changed before account creation.

4.6 No Account Abuse

You may not create multiple accounts or repeated guest sessions for the purpose of abusing free or promotional credits, circumventing limits, bypassing restrictions, or violating these Terms. Such conduct constitutes a material breach.

5. User Responsibilities

By using Shotexa — whether as a guest or as a registered user — you accept full responsibility for:

You agree to use Shotexa in compliance with all applicable local, national, and international laws and regulations, including but not limited to copyright law, data protection law, and criminal law.

5.4 No Misuse of Infrastructure

You agree not to misuse Shotexa's infrastructure, attempt to reverse-engineer the AI models or backend, scrape data, or use the service in ways that could damage, disable, or impair our systems or servers.

5.5 AI Output Review

You are responsible for reviewing AI-generated outputs before using or distributing them commercially. We do not guarantee that AI outputs are suitable for use on any particular marketplace (including Amazon, Shopify, Etsy, TikTok Shop, or others) or that they comply with third-party platform policies. You are solely responsible for complying with the rules of any platform on which you use or publish AI-Generated Content.

6. Prohibited Content, Conduct, and Credit Abuse

The following content and activities are strictly prohibited when using Shotexa. Violation of these prohibitions may result in immediate access restriction, account or session termination, reporting to relevant authorities, and legal action.

The following activities related to credits and free-tier access are strictly prohibited:

To protect the service and all users, Rockuno may rate-limit, deny credits, restrict or block guest sessions, restrict accounts, or limit access where abuse is suspected. These measures may be based on hashed device identifiers, hashed IP addresses, usage patterns, or other anti-abuse signals as described in our Privacy Policy.

Zero Tolerance: Any content involving the sexual exploitation of minors will result in immediate, permanent account or session termination and will be reported to the relevant law enforcement authorities and national reporting centers (e.g., BKA, NCMEC).

7. User-Generated Content

7.1 Ownership of Your Uploaded Content

You retain all intellectual property rights in the images and content you upload to Shotexa ("Your Content"). These Terms do not transfer any ownership of Your Content to Rockuno. This applies equally to guest users and registered users.

7.2 License Granted to Rockuno

By uploading content to Shotexa, you grant Rockuno a limited, non-exclusive, worldwide, royalty-free, sublicensable license to:

This license is granted solely for the purpose of operating and delivering the Shotexa service to you. We do not use your uploaded images for advertising, model training (without separate explicit consent), or any purpose beyond delivering the requested features.

This license terminates when you delete Your Content from the App, delete your account, or (for guest users) when your session data is deleted according to our Privacy Policy.

7.3 Your Representations

By uploading content, you represent and warrant that:

Rockuno reserves the right (but not the obligation) to review, remove, or disable access to any content that violates these Terms or that we are required to remove by applicable law. We may use automated content moderation tools as well as human review. Content moderation decisions are at our sole discretion.

8. AI-Generated Content and Ownership

8.1 Ownership of AI-Generated Results

When you use Shotexa to generate images using AI — as a guest or registered user — the resulting AI-generated output ("AI-Generated Content") is produced algorithmically based on your uploaded images and/or parameters. The question of copyright ownership in AI-generated works is actively evolving in law across jurisdictions.

Subject to your compliance with these Terms and to the extent permitted by applicable law:

8.3 User Responsibility for AI-Generated Content

You are solely responsible for determining the appropriateness, legality, and suitability of AI-Generated Content for your intended use. Rockuno provides the AI generation as a tool; the user bears full responsibility for how AI-Generated Content is used, published, or distributed. Rockuno shall not be liable for any claims, losses, or damages arising from your use or misuse of AI-Generated Content.

8.4 Rockuno's Technology Rights

The AI models, algorithms, processing pipelines, software code, and infrastructure underlying Shotexa's AI features remain the proprietary technology of Rockuno and/or its third-party AI providers. Nothing in these Terms grants you any rights to Rockuno's underlying technology.

9. AI Disclaimer

Important — please read this section carefully before using Shotexa's AI features.

9.1 Results May Vary

Shotexa uses artificial intelligence to generate and edit images. AI-generated outputs are probabilistic in nature. Results depend on the quality of your input, the complexity of your request, and the capabilities of the underlying AI model at the time of processing. We make no guarantees regarding the quality, accuracy, consistency, or suitability of any AI-generated result for any particular purpose.

9.2 No Guarantees on Output

Rockuno does not guarantee that:

9.3 AI Model Changes

The AI models and providers powering Shotexa may change at any time as we update our technology stack. Feature availability and output quality may vary following such updates. We will endeavor to communicate significant changes that materially affect the user experience.

9.4 No Human Review of AI Outputs

AI-generated images are not individually reviewed by Rockuno personnel before being delivered to you. You are responsible for reviewing AI-Generated Content before using or distributing it.

9.5 Sensitive Content Filters

Shotexa and its AI processing providers may apply automated filters and safety mechanisms to help prevent the generation of prohibited content. However, no automated system is perfect. If you encounter generated content that appears to violate our prohibited content policy, please report it immediately to info@rockuno.com.

10. Subscriptions, Credits, and Payments

10.1 Subscription Plans

Shotexa offers both free and paid subscription plans. Paid subscriptions grant access to premium AI features, higher usage limits, monthly credit allowances, and additional capabilities. Current subscription plans and pricing are displayed within the App and on the App Store listing.

10.2 Billing via Apple App Store

All in-app purchases and subscriptions for Shotexa are processed exclusively through Apple's In-App Purchase (IAP) system. By purchasing a subscription or credit pack, you agree to Apple's App Store Terms of Service and payment terms in addition to these Terms. Rockuno does not collect or process your payment information directly. All billing is handled by Apple. Purchases may be made as a guest or as a registered user.

10.3 Subscription Management via RevenueCat

Rockuno uses RevenueCat to manage subscription statuses, entitlements, and purchase events for both registered and guest users. RevenueCat receives purchase event data, receipts, subscription status information, and transaction identifiers from Apple to help us manage subscriptions, entitlements, and purchase validation. RevenueCat does not receive or process your payment card information. RevenueCat supports Restore Purchases functionality for both registered and guest users.

10.4 Auto-Renewal

Paid subscriptions automatically renew at the end of each monthly billing period unless you cancel at least 24 hours before the end of the current billing period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period. The renewal price is the price displayed at the time of purchase unless you are notified otherwise.

10.5 Free Trials

If a free trial is offered, it will be clearly disclosed in the App and on the App Store listing. If you do not cancel before the trial period ends, you will be automatically charged for the subscription at the applicable rate.

10.6 Price Changes

Rockuno reserves the right to change subscription prices. For existing subscribers, we will provide at least 30 days' advance notice of any price increase. Your continued subscription after the effective date of a price change constitutes acceptance of the new price.

10.7 Cancellation

You may cancel your subscription at any time through your iPhone Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period. You will continue to have access to premium features until that date. Cancellation does not entitle you to a prorated refund for the unused portion of the current period, except as required by law. Deleting the app or your account does not automatically cancel your App Store subscription.

10.8 Credits and Usage

Shotexa uses a credit-based system. AI image generations and related premium actions may consume credits. The number of credits required for a generation may vary depending on the selected feature, style, or processing type and will be shown in the App where applicable.

Subscription plans may include a monthly credit allowance. Current subscription credit allowances are displayed in the App and may include plans such as Starter, Pro, and Premium. New verified registered accounts may receive a one-time 3-credit welcome bonus as described in Section 4.4.

Credits are consumed when image generation jobs are submitted and processed. Credits may be refunded only if a generation fails due to a verified server-side error, at Shotexa's reasonable discretion or as described in the App's stated behavior. Credits otherwise have no cash value, cannot be exchanged for money, are not transferable, and are not redeemable upon cancellation, account deletion, or termination, except where required by applicable law.

Promotional credits (including guest credits and account bonuses) may expire or be subject to additional limitations where disclosed in the App.

10.9 One-Time Credit Packs

In addition to subscriptions, Shotexa may offer one-time consumable credit packs through Apple In-App Purchase. Purchased credit packs are added to your account or session balance after successful payment confirmation. Credit pack purchases are processed by Apple and are subject to Apple's refund policies. Credit packs may be purchased as a guest or as a registered user.

10.10 Restore Purchases

You may restore previous in-app purchases using the Restore Purchases feature in the App. Restore Purchases is available for both registered and guest users. If you later create or log into a registered account, purchases may be linked to that account where technically supported.

11. Refund Policy

Because all Shotexa subscriptions and in-app purchases are processed through the Apple App Store, Rockuno does not directly process refunds. All refund requests are governed by Apple's Media Services Terms of Sale and must be submitted directly to Apple.

How to Request a Refund from Apple

  3. Find the Shotexa purchase and select "Request a Refund"
  4. Choose a reason and submit your request

Apple will evaluate your refund request in accordance with their policies. Rockuno has no authority to override Apple's refund decisions.

EU Consumer Rights: If you are located in the EU and have made a purchase, you may have a right of withdrawal within 14 days of purchase under EU consumer law, unless the digital content has already been delivered and you expressly consented to its immediate delivery and acknowledged that you thereby lose your right of withdrawal. Please contact Apple directly regarding any such withdrawal rights.

12. Intellectual Property

12.1 Rockuno's Intellectual Property

The Shotexa application, including but not limited to its software code, design, user interface, graphics, logos, trademarks, trade names, and all underlying AI-related technology and infrastructure, are the exclusive intellectual property of Rockuno (Oemer Kaya) and/or its licensors. These are protected by copyright, trademark, and other applicable intellectual property laws.

Nothing in these Terms grants you any right, title, or interest in Rockuno's intellectual property, except the limited license to use the App as expressly set forth herein.

12.2 Trademarks

"Shotexa" and "Rockuno" are brand names and trademarks of Oemer Kaya (Einzelunternehmen). You may not use these names, logos, or marks without our prior written consent. Nothing in these Terms grants you any right to use Rockuno's trademarks.

12.3 License to Use the App

Subject to your compliance with these Terms, Rockuno grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, solely for your personal or commercial use consistent with these Terms and the App Store Terms of Service.

If you believe that content within Shotexa infringes your copyright, please send a written notice to info@rockuno.com including: (1) identification of the allegedly infringing material, (2) your contact information, (3) a statement of your good faith belief that the use is unauthorized, and (4) a statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

13. Account Termination and Access Restriction

13.1 Termination by You (Registered Users)

You may terminate your account at any time by using the in-app account deletion feature (Settings → Delete Account) or by contacting us at info@rockuno.com.

Account deletion may be subject to a 30-day grace period. During this period, your account is scheduled for deletion. If you sign in again before the grace period expires, the deletion request may be cancelled. After the grace period ends, your account and associated data will be permanently deleted according to our Privacy Policy, unless retention is required by law.

13.2 Guest User Data

Guest users do not have a registered account to delete. Guest session data may be deleted upon app uninstall or session expiry, subject to our Privacy Policy. Guest users may contact us at info@rockuno.com to request deletion of guest session data. Certain anti-abuse records may be retained as described in our Privacy Policy.

13.3 Termination or Restriction by Rockuno

Rockuno reserves the right to suspend, restrict, or permanently terminate your account or guest session, with or without notice, if:

Where abuse is suspected, we may also deny promotional credits, rate-limit access, or block sessions without full termination. For material or deliberate violations (including any prohibited content involving minors), termination will be immediate and permanent without prior notice.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

Where consumer protection laws in your jurisdiction do not permit the exclusion of certain warranties, the above exclusions apply to the maximum extent permitted by law. German consumer rights remain unaffected.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ROCKUNO (OEMER KAYA, EINZELUNTERNEHMEN) SHALL NOT BE LIABLE FOR:

WHERE ROCKUNO'S LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO ROCKUNO (THROUGH APPLE) FOR YOUR SUBSCRIPTION OR CREDIT PACKS IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) EUR 50.

Nothing in these Terms limits or excludes Rockuno's liability for: death or personal injury caused by gross negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited under applicable German law (including §§ 521, 309 BGB and the Produkthaftungsgesetz).

16. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Rockuno (Oemer Kaya), its employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

Rockuno reserves the right to assume exclusive control of the defense of any matter subject to indemnification by you, at your expense.

17. Third-Party Services and Links

Shotexa integrates with third-party services including Supabase (for registered and anonymous authentication, database, and storage), RevenueCat (for subscription and purchase management including anonymous purchase support), Vercel (for backend API hosting), PostHog (for product analytics, not advertising tracking), fal.ai (for AI image processing), and Apple (for App Store distribution and billing). Your use of these services is subject to their respective terms of service and privacy policies.

We use PostHog analytics solely to monitor app performance, understand feature usage, and improve the overall user experience. PostHog is not used for advertising, behavioral profiling, or cross-app tracking.

fal.ai may process uploaded images and generation-related data for the purpose of producing AI-generated image results. fal.ai acts as a data processor on our behalf and does not receive your identity or session data.

We may use internally hosted workflow automation infrastructure for job status handling and operational notifications. This infrastructure processes only the minimum data necessary to fulfil these technical functions.

Rockuno does not control and is not responsible for the terms, policies, or practices of any third-party services. We encourage you to review the terms and privacy policies of all third-party services you interact with through the App.

The App may contain links to third-party websites or resources. Such links are provided for your convenience only. Rockuno has no control over those sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

Apple as a Third-Party Beneficiary

You acknowledge and agree that Apple, Inc. is a third-party beneficiary of these Terms with respect to your license to use the App on Apple devices. Upon your acceptance of these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof. These Terms are solely between you and Rockuno, not between you and Apple. Apple is not responsible for the App or its content.

18. Governing Law and Dispute Resolution

18.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

18.2 Jurisdiction

For disputes with consumers in the EU: you have the right to bring legal proceedings in the courts of your country of residence or in the courts of Germany.

For disputes with business users: the exclusive place of jurisdiction shall be the courts of the registered place of business of Oemer Kaya (Einzelunternehmen), Germany.

18.3 Online Dispute Resolution (EU)

The European Commission has established an Online Dispute Resolution (ODR) platform for resolving disputes between consumers and businesses. Consumers in the EU may use this platform to submit complaints: https://ec.europa.eu/consumers/odr

Rockuno is not obligated to participate in dispute resolution proceedings before a consumer arbitration board but may do so voluntarily.

18.4 Informal Dispute Resolution

Before initiating any formal legal proceedings, we encourage you to contact us at info@rockuno.com to attempt to resolve the dispute informally. We will endeavor to resolve any issue within 30 days of your written notice.

19. Changes to These Terms

Rockuno reserves the right to modify these Terms at any time. When we make material changes, we will:

Your continued use of Shotexa after the effective date of revised Terms constitutes your agreement to those Terms. If you do not agree to the revised Terms, you must stop using the App.

Previous versions of these Terms are available upon request.
